Employers must allow employees to be represented by a colleague or trade union representative at a DISCIPLINARY HEARING.   In certain circumstances, employees also have the right to be represented by a Lawyer.
 
In a recent High Court case, the Judge said that the gravity of the allegations made against the Defendant, along with the very srious impact upon his future working life of a potential section 142 direction were such that he was entitled to legal representation at the disciplinary and appeal hearings.
