27/08/2008      DISCRIMINATION AND HARRASSMENT - NEW EUROPEAN COURT OF JUSTICE RULING

Coleman v Attridge Law and Steve Law
 
The European Court of Justice (ECJ) has ruled that council directive 2000/78/EC must be interpreted to mean that prohibition of direct discrimination and harassment is not only limited to people who are disabled.
 
The decision means an employer will be in breach of the directive when it treats non-disabled employees less favourably, or subjects them to harassment, if the less favourable treatment or harassment is based on the employees’ association with a disabled person.
