Why your Will is so important

The Law Society of England and Wales issued a warning today: If you fail to make a Will, your death could create significant problems for your grieving family and friends.

Marking Dying Matters Awareness Week, Law Society president Jonathan Smithers urged everyone to ensure they have a professionally written will.

He said: ‘Everyone knows making a Will is important to ensure their wishes are followed after they die, but it’s often put off. This week is a chance to consider who you want to benefit and get your Will written, providing peace of mind for you and your family.’

Complex Family Structures

Family structures are more complex now, and more people own property that has significantly increased in value over their lifetime.

Smithers said: ‘It is worth taking care over a will to make sure that you understand tax liabilities and that property rights are properly addressed. A solicitor can help explain the complexities and help you avoid any pitfalls.’

Intestacy

The legal consequences of dying without a Will can be significant. These consequences vary depending on your marital status. They also depend on whether you have children or other surviving relatives. The value of your estate is another factor that will affect the outcome.

In England and Wales, unlike Scotland, anyone can offer will-writing services to the public, with no professional qualifications or training.

Smithers warns: ‘Beware of cheap Will-writing services. A poorly drafted Will can cause significant financial and emotional distress for your loved ones. A solicitor can help you avoid unintended consequences.’
